Gift Card Terms
These Gift Card Terms govern the purchase, delivery, and redemption of gift cards on the TheWILL.ai platform. The same operator runs TheWILL.ai (estate planning), Expat183 (tracking the days you spend in each country) and Orchard72 (portfolio tracking); gift cards are issued for the TheWILL.ai platform only, and these terms cover no purchase made on the other sites. They supplement our Terms of Service and Privacy Policy.
1. Overview
Gift cards may be purchased on the TheWILL.ai platform and redeemed by recipients towards any product or subscription offered on the platform. Gift cards are issued by Orchard72.
2. Purchase Terms
- Anyone may purchase a gift card. You do not need an account, and you do not need to sign in. Registered users can buy from their account checkout; everyone else can buy as a guest.
- Gift cards are available in the denominations displayed on the platform at the time of purchase.
- Each gift card purchase is a one-time charge. Gift cards do not auto-renew.
- Any applicable tax is calculated based on the purchaser's payment card issuing country.
- The purchaser receives a confirmation email upon successful purchase.
- The recipient receives a gift notification with a redemption link at the email address provided by the purchaser.
Invalid recipient email: If the recipient email address is invalid or bounces, the purchaser will be notified and may re-enter a correct email address within 30 days. After 30 days with no valid delivery, the gift card is automatically refunded to the purchaser.
2.1 Buying as a guest, without an account
How we identify you: A guest purchase is identified by the email address you give at checkout together with a unique order reference, sometimes called an order token, that we generate for that order. We send both to you in your confirmation email. That order reference is how you check the status of your order, ask us to resend the gift, and prove the order is yours if you contact us. Treat it like a receipt: anyone holding it can see the status of that order, so do not share it. We never ask you to set a password to buy as a guest, and buying as a guest does not create an account for you.
Turning a guest order into an account: If you later create an account using the same email address, you can attach your guest order to it from the order page and manage the gift from your account afterwards. You are not obliged to do so, and the gift works either way.
Your cancellation rights as a guest buyer: A guest buyer has the same statutory cooling-off right as an account holder. We do not ask you to give up that right at checkout, because buying a gift card does not by itself start a service for you. Under the Consumer Contracts Regulations 2013 that right can end early for digital content that has been supplied during the cooling-off period with your consent and acknowledgement; for a gift card, supply happens when the recipient redeems it, so your right ends at redemption rather than at purchase. Until the card is redeemed, you may cancel an unredeemed gift card at any time for a full refund, whether or not you hold an account.
How a guest buyer asks for a refund: Use the contact form and quote the order reference from your confirmation email along with the email address you used. You do not need to create an account to request a refund. Refunds go back to the card you paid with. Our Refund Policy sets out how refunds are handled generally.
Disputes and chargebacks: If a payment is disputed with your bank or card provider, or fully refunded, and the gift card has not yet been redeemed, we cancel the code so it can no longer be used, and we tell the purchaser we have done so. If the recipient has already redeemed the gift card, we do not take the credit back from them. The recipient played no part in the payment and keeps what they were given; we record the loss on our side instead. If you think a purchase was made with your card without your permission, contact us with the order reference and we will investigate.
3. Redemption
- The recipient must have or create an account on TheWILL.ai to redeem a gift card.
- Credit is applied to the recipient's account balance upon redemption.
- Gift card credit may be used for subscriptions, one-time products (including Mirror Wills for couples), or add-ons available on the platform. A single gift card may cover the couple fee for Mirror Wills, apart from the minimum card payment described below.
- Gift cards cannot be exchanged for cash, transferred to another user, or used to purchase further gift cards.
- Gift cards do not expire. There is no deadline by which the recipient must redeem one.
How credit is applied: Your credit is applied automatically when you pay, and the checkout summary shows the amount taken off before you confirm.
- Subscriptions: credit is taken off each subscription payment until it is used up.
- One-time products and add-ons: credit is taken off the price at checkout. If your credit would cover the whole price, a small card payment (the minimum our payment processor accepts) is still taken, and the rest of your credit stays on your account.
- Credit is held in the currency the gift card was bought in and can only be spent on purchases charged in that currency. We do not convert it into another currency.
- If a purchase you paid for partly with credit is refunded, the credit used is returned to your account balance.
Partial redemption: If only part of the gift card value is used, the remaining credit balance stays on the recipient's account and keeps its value. We do not remove an unused balance after a period of time.
4. Refunds
- No expiry, no forfeiture: A gift card does not expire and we do not take back an unused balance, however long it goes unredeemed. A gift card is money you have already paid us, so keeping it for ourselves because nobody redeemed it in time would be charging you for something we never supplied.
- Statutory cooling-off: Under the Consumer Contracts Regulations 2013, you have a statutory statutory cooling-off period for unredeemed gift cards, during which you may request a full refund to the purchaser.
- Partially redeemed: Once any portion of the gift card has been redeemed, the gift card is non-refundable to the purchaser, because the value has passed to the recipient. The recipient keeps any remaining balance for as long as they hold the account. This does not affect any pro-rata refund you may be entitled to for the unused balance if you cancel within the statutory statutory cooling-off period under the Consumer Contracts Regulations 2013.
- Pre-redemption revocation: The purchaser may request cancellation of an unredeemed gift card at any time for a full refund. Once any portion has been redeemed, the gift card is non-refundable.
- If we discontinue the service: a gift card is a prepayment, and we would rather tell you now how it would be treated. Where we discontinue the service and are able to meet our obligations, an unredeemed balance is either honoured during the 90-day notice period described in Section 13 of the Terms of Service, or refunded to the purchaser. Where we enter administration or liquidation, an unredeemed balance ranks as an unsecured claim, which may be paid in part or not at all. Gift-card money is not held separately from our own funds and is not held on trust. This is given as information about how the law would treat such a claim, not as a term you are agreeing to, and it does not affect your statutory rights.
5. Recipient's Rights
By redeeming a gift card, the recipient agrees to be bound by our standard Terms of Service and Privacy Policy.
If the recipient uses the gift card credit to subscribe to a plan, they may cancel the subscription at any time. Cancellation takes effect at the end of the current billing period. No refund is issued to the purchaser for gift card credit used on a subsequently cancelled subscription.
6. Data Processing
- Purchaser data: Processed for the purpose of completing the transaction and retained in accordance with financial record retention requirements (7 years).
- Recipient email: Used solely for gift delivery and redemption. The recipient's email address is not added to marketing lists.
- Redemption data: Gift redemption records are linked to the recipient's account for account balance management and audit purposes.

7. Governing Law
These Gift Card Terms are governed by the laws of England and Wales, and any dispute arising out of or in connection with them is subject to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you retain the right to bring proceedings in the courts of the country in which you are habitually resident, and to rely on any mandatory consumer-protection laws of that country that cannot be derogated from by agreement.
