Do I Need an Attorney to Write a Will in South Africa?
South African law does not require you to use an attorney to make a will. What it does require is that the will is signed and witnessed the way the Wills Act 7 of 1953 says. This guide sets out what that means and where advice tends to help.
The short answer
No. A will you write yourself, or make with an online will service, can be just as valid as one drafted by an attorney, provided it meets the signing and witnessing rules of the Wills Act.
That generally means a written will made by someone aged 16 or over, signed at the end by you, or your signature acknowledged by you, in the presence of two competent witnesses who are present at the same time and who then sign in your presence and each other’s. If the will runs to more than one page, each page is signed as well.

What tends to tip the balance
None of these makes an attorney compulsory. They are the situations where people most often decide the extra cost is worth it.
Married in community of property
A will can generally only deal with your half of a joint estate, so the marital regime shapes what the will can do.

Leaving assets to minor children often means setting up a trust in the will, which is where people most often take advice.
A business or farm
Company shares, a farm or assets held in a trust usually need a succession plan that sits alongside the will rather than inside it.
Assets overseas
